Existing SC free public WiFi terms and conditions

Welcome to the Sunshine Coast Free Public Wi-Fi (SC Free Public WiFi) brought to you as a free service by Sunshine Coast Council (ABN 37 876 973 913) and its partners Telstra (ABN 33 051 775 556) and Entag (ABN 66 162 344 738) (the ‘provider’).

These terms and conditions (terms) are between the Sunshine Coast Council (council) and you. By using this SC Free Public WiFi you agree to be bound by these terms. If you do not wish to be bound by the terms of this agreement, you must discontinue your use.

From time to time council changes or ads to SC Free Public WiFi, including these terms, without notice. Any change to these terms will be effective as soon as they are published. You should review these terms regularly to check for updates. By using SC Free Public WiFi, you accept the terms in force at the time of access.

For the purposes of these terms any reference to 'you' or 'your' includes but is not limited to the owner and authorised user of the computer or mobile device used to access SC Free Public WiFi.

Logging in/out

To log into SC Free Public WiFi you must accept these terms by selecting 'I agree'.

You are responsible for providing your own computer or mobile device (wireless enabled device), information technology advice or assistance are not provided to any user.

There is no requirement to log out of (quit) SC Free Public WiFi. You simply need to close your Internet browser.

You will automatically be logged-out of SC Free Public WiFi if:

  • your access is terminated by the provider in accordance with these terms and conditions.
  • the wireless connection you are accessing is lost, disconnected or becomes out of range.
  • no activity is detected from your wireless-enabled device for a continuous period of 10 minutes while you are logged on.
  • if you exceed what is considered reasonable usage (2 hours) of the hotspot.

If you are in the process of downloading a file and you lose connection or are automatically logged-out, your partially downloaded file will not be saved and/or be recoverable. It is recommended that you save your work regularly and/or take the necessary precautions to prevent such occurrences.

If you are automatically logged out, you will need to log in again. There is no guarantee that you will be able to immediately log back in.

User obligations and limitations

SC Free Public WiFi must be used in accordance with the law in an ethical and professional manner. You must not use the SC Free Public WiFi:

  • for any illegal, improper or malicious purpose.
  • to create or transmit a computer virus knowingly.
  • to access other computers or data on the internet without permission.
  • to publish or distribute material that is obscene, defamatory, abusive or that violates any law or regulation.
  • to conduct an illegal business.
  • to alter or modify the radio transmission equipment.
  • could cause the council to be in breach of any law, code, or instrument which governs its conduct or to incur a liability to any third party or entity.

The provider may immediately terminate and block your access to the service if access contravenes these terms.

The Sunshine Coast Council uses filtering software to block known offensive websites, but responsibility for adherence to the user obligations resides with the individual.


The WiFi network automatically detects WiFi enabled devices as they enter and move through the coverage area.  The network uses the beacons that every Wifi enabled device periodically emits collect information of the number and movements of devices. 

Once the terms have been agreed to, the council will record information relating to use of SC Free Public WiFi. Information recorded includes:

  • location of the device accessing SC Free Public WiFi
  • time of log on and log off
  • web services accessed by a device
  • the web browser type and/or operating system information
    • if a device has previously logged on to the service.

The MAC address of the device that has accessed the SC Free Public WiFi is used to obtain this information. A device’s MAC address does not provide any person details about the individual who owns or is using the device.  MAC addresses are anonymised with an irreversible encryption before storage in a data centre.

The council does not capture personal information of individuals accessing the service unless the user opts into providing that information while using the SC Free Public WiFi service.

If you choose to provide personal information, it will be treated in line with council’s privacy policy.


Council cannot guarantee the security of the service at all times. Your access and use is at your own risk. The onus is on you as user, to ensure that usernames, passwords and security-based information are kept private and the firewalls are installed to prevent unauthorised access.

Council is not liable for any kind of loss or damages you may sustain as a result of your use of the hotspot.

Speed and reliability of the hotspot

SC Free Public WiFi provides you with free broadband internet access. The council will undertake reasonable endeavours will be used to provide you with a reliable, stable and secure access to the service but does not promise that the access will be continuous, fault-free, secure or accessible at all times.

SC Free Public WiFi access is not suitable for supporting any application or use which requires continuous, fault-free connectivity or uninterrupted data traffic flow. Without limiting any other provision of these terms and conditions, the provider will not be liable if the SC Free Public WiFi access becomes unstable, un-secured, slow or unavailable for any reason whatsoever.

Reasonable endeavours will be used to monitor and attend to any faults, malfunctions or other problems but will not be liable if such faults, malfunctions or problems occur and shall not be obligated to rectify any such faults, malfunctions or problems associated with in any specified timeframe.

Release and Indemnity

By accepting the terms, you release and discharge council from any liability which might arise from the use of SC Free Public WiFi, including liability in relation to defamatory or offensive material or any breach of the copyright which may occur as a result of use.

You agree to indemnify and must defend and hold harmless council, its employees and agents, from and against all loss, damage, liability, charge, expense (including all reasonable legal and other professional costs on a full indemnity basis) of any nature or kind arising from your breach of these terms and conditions.
