TLPI 02/2013 (Vegetation Protection Overlay)

Adopted temporary local planning instrument overriding Maroochy Plan 2000, The Noosa Plan 2006 and Caloundra City Plan 2004.

On 12 June 2013 council adopted a temporary local planning instrument overriding the Maroochy Plan 2000, Noosa Plan 2006 and Caloundra City Plan 2004 in accordance with Section 117 of the Sustainable Planning Act 2009. The Maroochy Plan 2000 and Caloundra City Plan 2004 are now superseded by the Sunshine Coast Planning Scheme 2014. The temporary local planning instrument is:

Council's vegetation management provisions help protect the region’s natural resources, maintain biodiversity and conserve ecological values. The temporary local planning instrument enables council to prevent unwarranted vegetation damage and ensure that where necessary, vegetation removal occurs in a responsible way.

The object of the temporary local planning instrument is to ensure that upon the expiry of Temporary Local Planning Instrument No. 1 (Protected Vegetation Overlay) 2012, operational work for clearing protected vegetation within parts of the local government area is appropriately managed through the three planning schemes. The temporary local planning instrument affects the operation of the three planning schemes for the local government area by applying the provisions of Part 3 (Protected vegetation overlay) of the temporary local planning instrument to the planning schemes.

Start of the temporary local planning instrument

A temporary local planning instrument may suspend or otherwise affect the operation of a planning scheme for up to one year.

The temporary local planning instrument comes into effect on 24 June 2013 and will cease to have effect on 23 June 2014.

Council will not distribute printed copies of the temporary local planning instrument.
