Terms and conditions

  1. This competition is run by the Sunshine Coast Council (otherwise referred to below as council).
  2. Promotional partner - Buy Local Sunshine Coast, Level 3/2 Maroochy Blvd, Maroochydore QLD 4558.
  3. Entries and information on prizes and how to enter form part of these terms and conditions. 
  4. Entrants will be responsible for all costs associated with entering the competition, which may include the costs associated with accessing the internet.
  5. Entrants may enter as many times as they wish, provided that each entry is based on a separate Eligible Purchase and separate online entry form.
    • Entrants must retain a copy of their Eligible Purchase receipt to verify each entry.
  6. To be eligible to win a prize, you must comply with these terms and conditions.
  7. Participation in this competition constitutes acceptance of these terms and conditions. Entry into the competition signifies acceptance of all conditions of entry.
  8. Acceptance of a prize signifies acceptance of the conditions of accepting a prize. Entrants are required to abide by the terms and conditions as presented. 
  9. Directors, officers, management and employees (and the immediate families of directors, officers, management and employees) of the Promoter, or of the agencies or companies associated with this competition are ineligible to enter.
  10. The competition is open only to Australian permanent residents, who are aged 18 and over and who reside in the state of Queensland.
  11. To take part in the competition, a participating business must be:
    1. permanently established, based in and conduct their business within the Sunshine Coast Local Government Area (defined in paragraph 21 below); and
    2. a registered COVID safe business, with a COVID-19 Safe Plan in place.

      The following business types are not eligible to take part in the competition:
      • non-COVID safe businesses
      • gambling or tobacco
      • food delivery services
      • ride share services
      • public transport
      • adult entertainment services
      • private rentals
      • pawnbrokers.

      Final inclusion of a participating business in the competition is at the sole discretion of the Promoter.

  12. There will be four (4) weekly competition periods:
    • Week 1: starts 6am (AEST) on 22/11/2021 and ends 11.59pm (AEST) on 28/11/2021
    • Week 2: starts 12am (AEST) on 29/11/21 and ends 11.59pm (AEST) on 5/12/2021
    • Week 3: starts 12am (AEST) on 06/12/2021 and ends 11.59pm (AEST) on 12/10/2021
    • Week 4: starts 12am (AEST) on 13/12/2021 and ends 11.59pm (AEST) on 19/12/2021.
  13. To enter a Weekly Competition Period, entrants must (during the applicable Weekly Competition Period):
    (a) spend a minimum of $10 on any product or service from a Participating Business (Eligible Purchase); and
    (b) visit the Buy Local website to upload a copy of their receipt of their Eligible Purchase and to fully complete and submit the online entry form, including providing any additional information as required by the Promoter. Entrants may enter as many times as they wish, provided that each entry is based on a separate Eligible Purchase and separate online entry form.
  14. Entrants must retain a copy of their Eligible Purchase receipt to verify each entry. 
  15. There will be four (4) draws conducted overall, with one (1) draw to be conducted in respect of each Weekly Competition Period. 

    The draws will be conducted by the Promotional Partner and take place at BDO Australia - Sunshine Coast, located at Level 3/2 Maroochy Blvd, Maroochydore QLD 4558, at the times and on the dates below:

    • Week 1: draw 9am (AEST) 29/11/21
    • Week 2: draw 9am (AEST) 6/12/21
    • Week 3: draw 9am (AEST) 13/12/21
    • Week 4: draw 9am (AEST) 20/12/21
  16. The first valid entry randomly drawn in each weekly draw, from all valid entries received by the close date and time of the relevant Weekly Competition Period, will win a prize. Any non-winning entries received in respect of each relevant Weekly Competition Period will not roll-over to subsequent weekly draws. 

  17. The winners will be notified by phone and email within two days of the relevant draw and their names will be published on Sunshine Coast Council’s digital platforms and www.buylocalsunshinecoast.com.au 

  18. There are four (4) prizes to be won, one (1) in respect of each Weekly Competition Period.
    Each winner will receive a prize worth up to $2,000 (inc GST), given in the form of either:
    a. gift card(s) for use at one or more Participating Businesses; or
    b. direct purchases of product(s) or service(s) from one or more Participating Businesses. 

  19. Each winner will nominate how they would like to redeem their prize, up to a maximum value of $2,000 (inc GST).  For example, a winner could request a $1,000 gift card for use at Participating Business A, a $500 gift card for use at Participating Business B and a product or service worth $500 from Participating Business C.

  20. The competition closing date is 11.59 pm, 19 December 2021. 
  21. Each winner must have nominated how to redeem their prize by 5pm (AEST) on 31/03/2022.
    If for any reason a winner does not nominate how they would like to redeem all or part of their prize by 31/03/2022, the prize, or any remaining value of the prize not redeemed, will be forfeit.
  22. Unclaimed Prize Draw Details - 9am (AEST) on 01/04/2022, at the same location as the original draw.
    Any winner(s) in the Unclaimed Prize Draw will be notified by phone and email within two days of the Unclaimed Prize Draw and their name will be published on Sunshine Coast Council’s digital platforms and Buy Local.
  1. Information regarding prizes and how to enter forms part of these conditions. By entering, entrants accept these terms and conditions.
  2. Entries into each weekly draw must be received by the close date and time of the relevant Weekly Competition Period. Entries are deemed to be received at the time they are received by the Promoter’s database and not at the time of submission by the entrant. Any entry that is based on a returned Eligible Purchase (except where due to defect of the product) will be deemed invalid. Failure of an entrant to provide their receipt/s (as per the Retain Receipt Requirements) (without alteration) to the Promoter upon request may, at the Promoter’s discretion, result in an invalid entry (and, at the Promoter’s discretion, in all of the entrant’s entries being invalid).
  3. The Promoter has no control over communications networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred. Entrants who enter using multiple email addresses, phone numbers or aliases may be disqualified. Consumers are responsible for their own costs associated with accessing the Internet. Automatically generated entries may be disqualified.
  4. The Promoter is not liable for late, incomplete, indecipherable, misdirected, incorrectly submitted, or delayed entries, correspondence or claims for prizes due to error, omission, tampering, theft, destruction or otherwise.
  5. The draws will be conducted at the times, on the dates and at the locations as stated in the Draw Details.
  6. The prizes are as stated in the Prize Details. Winners will not receive $2,000 cash. The prizes, and any unused portion of a prize, are not transferable or exchangeable and cannot be redeemed for cash. Prizes not redeemed in accordance with the Prize Claim Date and Time will be forfeited and cash will not be supplied instead. The Promoter reserves the right to determine (in its discretion) if the particular product(s) and/or service(s) nominated by a winner (for the purpose of that winner redeeming their prize) complies with these terms and conditions. The Promoter is not responsible if any product(s) and/or service(s) nominated by a winner are unavailable for any reason. All gift cards and vouchers are subject to the terms and conditions imposed by the respective supplier, including periods of validity. Winners’ selected product(s) and/or service(s) may be subject to additional terms and conditions as set by the prize supplier. Redemption decisions are final and the Promoter is not responsible for any changes of mind. The Promoter is not liable if any event or activity redeemed as part of a prize is abandoned, called off or postponed for any reason, in which case the affected winner(s) forfeit that component of the prize, and no cash or alternative prize(s) will be substituted for that component of an affected winner’s prize. Winners are responsible for all costs associated with using and maintaining any product(s) and/or service(s) obtained through redemption of their prize.
  7. Winners will be notified in accordance with the Winner Notification and Publication section of these conditions.
  8. The winners must, at the Promoter’s and/or Promotional Partner’s request, participate in all promotional activity (such as publicity and photography) surrounding the winning and redemption of their prize, free of charge. The winners consent to the Promoter, the Promotional Partner, and their respective agencies using their names, suburbs, images and/or voice in promotional material (including photograph, film and/or recording) for an unlimited period, without remuneration, for the purpose of promoting this competition (including any outcome) and promoting any Participating Business.
  9. The Promoter may require winners to provide proof of identity, proof of age and proof of residency. Identification considered suitable for verification is at the Promoter’s discretion. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
  10. If a winning entry is deemed not to comply with these conditions, the entry will be discarded and a new winner of that prize will be determined by drawing a further valid entry in accordance with the Unclaimed Prize Draw Details, as applicable.
  11. The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, any person (including without limitation a winner) who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent or effect of annoying, abusing, threatening or harassing any other person or behaves in a manner which may diminish the good name or reputation of the Promoter or any of its related bodies corporate or the agencies or companies associated with this competition, is contrary to law or is otherwise inappropriate.
  12. The Promoter may in its absolute discretion cancel a prize or otherwise cease to provide any benefit of a prize to a winner if the winner, in the opinion of the Promoter, behaves in a manner which is contrary to law, may diminish the good name or reputation of the Promoter, the Promotional Partner, or any of the agencies or companies associated with this competition, or is otherwise inappropriate.
  13. Failure of the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s decision is final and no correspondence will be entered into.
  14. If any prize has not been accepted or claimed in accordance with the Prize Claim Date and Time or if, after making all reasonable attempts, the Promoter cannot contact the drawn winner (or the drawn winner does not contact the Promoter) by the Prize Claim Date and Time, the relevant winner’s entry will be deemed invalid and the Promoter will conduct such further draws in accordance with the Unclaimed Prize Draw Details as are necessary to distribute the relevant prize. All non-winning entries received during the Overall Competition Period will be combined for the purposes of this draw. Any winner(s) in this draw will be notified as stated in the Unclaimed Prize Draw Winner Notification and Publication.
  15. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits(including loss of opportunity)), expense, damage, personal injury, illness or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). Nothing in these conditions restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).
  16. Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage, loss or delay in transit to the prize(s) or be liable for any damage that occurs to a prize whilst it remains on premise at a Participating Business. Prize(s) will be delivered in Queensland, Australia only.
  17. The Promoter may communicate or advertise this competition using Instagram, Facebook or any other social media platforms (“Social Media Platforms”). However, the competition is in no way sponsored, endorsed or administered by, or associated with the Social Media Platforms. Entrants are providing their information to the Promoter and not to the Social Media Platforms. Each entrant completely releases all Social Media Platforms from any and all liability.
  18. If for any reason any aspect of this competition is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected entries, subject to the approval of all relevant gaming authorities, if required.
  19. The Promoter is not liable for any tax implications arising from prize winnings. Independent financial advice should be sought. Where this competition involves, for GST purposes, supplies being made for non-monetary consideration, entrants will follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
  20. All entries will be the property of the Promoter, including its Promotional Partner. The Promoter collects personal information from entrants in order to conduct the competition and may, for this purpose, disclose such information to third parties, including but not limited to the Promotional Partner, agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. The Promoter may, for an indefinite period, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages, sending a message by post, or telephoning the entrant. Entrants should direct any request to access, update or correct their personal information to the Promoter. Read the Promoter’s Privacy Policy.
